Students have statutory accident insurance for all events at the sports center with a trainer. Sporting activities in which the sports center only provides sports facilities for free use (e.g. free tennis games, ball games, running on the Finn track, etc.) are not included. Likewise, there is no accident insurance from the state accident insurance fund for competitions (e.g. German university championships) or excursions abroad.
For all employees of the university (not civil servants, not trainers of the sports center) there is insurance coverage according to §2 Abs.1 SGB VII, as long as it is an event of the sports center with a trainer. A sports accident is considered an occupational accident and is insured through the state accident insurance fund if the sporting activity takes place within the framework of a company sport. According to a ruling of the BSG (16.01. - 28.11.61), the following criteria must be met for this:
The sporting activity must
offer a balance to the work-related physical strain
be oriented toward mass sports (no pure participation in competitive sports)
be limited to members of the university and be business-related.
These criteria are generally met for university sporting events, with the exception of competitive groups. Sports activities in which the Sports Center merely provides sports facilities for free use (e.g., free tennis games, ball games, running on the Finn track, etc.) are not included. Likewise, there is no accident protection by the state accident insurance fund during competitions, e.g. German university championships as well as during excursions (skiing, sailing and surfing courses).
For civil servants, an accident during university sports is only considered an official accident if, in addition to the aforementioned criteria, the following conditions are met (Circular of the Ministry of Finance dated November 4, 1997 - NdsMBl. 47/1997):
the group must be instructed by an exercise leader appointed by the supervisor.
an attendance list must be maintained
an approved exercise plan must be in place for the group.
For sports accidents, status groups a) and b) in the sports center are required to submit an accident report. Forms are available in the office or online at www.luk-nds.de. Civil servants must report the accident to the Department 12 of the TU.
These participants are not insured through the State Accident Insurance Fund (Landesunfallkasse) in the case of sports accidents. In such cases, individuals should rely on their own health insurance. If the cooperative partner is a sports club that is a member of the City Sports Federation, their participants are covered by the club's accident insurance.
