Legal disclaimer
Hamburg District Court has decided that anyone who adds a website link must assume responsibility for the contents of the linked page. According to the District Court, this can only be prevented in the event of dissociation from the contents. To this end, we have formulated detailed liability conditions. The Leichtweiß-Institute is hereafter abbreviated to LWI:
1. Content of the online material
The LWI assumes no liability for the status, correctness, completeness or quality of the information it supplies. Acquisition claims that refer to damages of a material or conceptual nature, caused by the use or non-use of the available information or by the use of incorrect and incomplete information, are basically excluded provided that LWI staff have not caused the said damages demonstrably through gross negligence or with intent, unless there is evidence of culpable violation of essential contractual obligations or cardinal obligations. In this case, the liability of LWI is limited to typical damages that can be anticipated in an owner-user relationship. The amount guaranteed is set at 500 Euros apart from any intentional damages. All estimates are non-binding. The LWI exclusively reserves the right to modify, supplement, delete or adjust publication either temporarily or permanently, of parts of pages or of all the material, without prior notification.
2. Links
In the case of direct or indirect links to external Internet sites that lie outside the institute's jurisdiction, statutory liability shall apply only in cases in which the author is aware of the content and would be technically and reasonably capable of preventing the use of unlawful subject matter. The LWI hereby expressly declares that no illegal content was evident on the linked pages at the time at which the link was established. LWI has no jurisdiction over the current and future structure, contents and/or authorship of linked pages. LWI thus dissociates itself from all linked pages that were modified after the link was implemented. This applies for all links created within the institute's own internet material and for foreign entries in guestbooks compiled by the author, discussion forums and mailing lists, for instance. In the case of illegal, erroneous or incomplete contents and especially for damages arising from the use of such information, the provider of the page in question assumes sole liability and not the party referring to the respective publication via the links.
3. Copyright and law pertaining to trademarks and related signs The LWI endeavours to comply in all publications with the copyright relating to the graphics, sound files, video sequences and texts used. All of the brand names and trade marks mentioned in the Internet material and, where applicable, protected by a third party, are subject without reservation to the terms and conditions of the respectively valid law pertaining to trademarks and related signs and to the property rights of the respective stipulated proprietors. The fact that trademarks have merely been named shall not imply that they are not protected by third party rights. The copyright for published items compiled by LWI members themselves remains solely with the authors. The reproduction or use of such graphics, sound files, video sequences and texts in other electronic or printed publications is prohibited without the express permission of the originator.
4. Data privacy
If feasible, the decision to enter personal or business data (e-mail addresses, names and addresses) in the internet material is entirely voluntary. The use of all services offered - if technically possible and reasonable - is permitted without specifying personal data or by entering anonymous data or a pseudonym.
5. Legal validity of this liability regulation
If sections or the individual wording of this liability regulation do not comply, no longer comply or do not completely comply with current legislation, the content and validity of the other provisions are unaffected.
